Description

Tomás is a partner in the Dispute Resolutionand Antitrust practices at A/C/R. He has extensive experience in economic disputes, antitrust matters, arbitration, corporate conflicts, securities and commercial litigation, among others. He has led the defense of national and multinational companies in the most significant cases of the past decadei nvolving collusion, abuse of dominant position, gun-jumping, and interlocking. In the commercial field, he has represented entities from various industries incomplex arbitration proceedings related to corporate matters, sophisticated business transactions, and construction disputes.

He has also specialized in non-contentious and preventive advisory services in the field of antitrust law, particularly in matters related to merger control, interlocking, and the ongoing support required by his clients for the proper conduct of their commercial activities.

Before joining A/C/R, he was a partner at Bofill Mir Abogados and Ferrada Nehme, and also served as an attorney in the Litigation Division of the National Economic Prosecutor’s Office (FNE), as well as an associate at Carey y Cía.

· Representation of the world’s most prominent Chinese company in the lithium industry in a dispute with the Chilean Financial Market Commission (CMF) regarding an agreement reached between the State of Chile and the largest lithium marketerin the country.

· Representation of a Spanish conglomerate active in the aerial firefighting industry in three court proceedings for collusion, conducted between 2017 and 2025.

· Representation of a cable operator in a case of abuse of dominant position against the holder of broadcasting rights for Chile’s national football championship  matches, resulting in a judgment ordering the latter to pay approximately USD28 million.

· Representation of one of the world’s leading multinational retailers in a high-value civil commercial dispute with a supplier.

· Representation of foreign power generation companies in international arbitrations concerning breaches of construction contracts.

· Representation of a banking institution in a commercial arbitration related to forward contracts.

· Representation of a multinational mining company in an environmental damage claim arising from a sinkhole in the city of Tierra Amarilla.

· Representation of a Valdivia-based retailer in an unfair competition dispute involving abuse of judicial actions against a competing shopping center operator in thesame city.

· Representation of a foreign company in the only gun-jumping case that has been litigated in Chilean courts.

· Filing,handling, and successful resolution of the first leniency applications submitted to the Chilean National Economic Prosecutor’sOffice (FNE).
